All the casinos that operate under that platform, Malina, Pistolp, Myempire, Casinia...etc... operate illegally.

Their terms and conditions are abusive and contrary to both Spanish and European Union law. Operating without a license in a European Union member state, such as Spain, as in my case, means that the operations of that casino or casino platform are illegal, regardless of the terms and conditions.

The abusive practices I can demonstrate from these casinos include not paying out prizes won in raffles, withholding winnings with absurd account verifications, or closing accounts without any justification.

The lack of attention to self-exclusion, the promotion of gambling, automated responses, misleading advertising, failure to respond and account closure when you ask if they are licensed, misappropriation of funds...

I personally offered to reach an amicable settlement before taking the legal measures, both administrative and criminal, that I will take against them.

Todos los casinos que operan bajo esa plataforma, Malina,Pistolp, Myempire, Casinia....etc... Operan desde la ilegalidad.

Sus términos y condiciones son abusivas y contrarias tanto a la legislación española como al legislación de la Unión Europea. El operar sin licencia en un estado miembro de la Unión Europea por ejemplo España, como en mi caso, resulta determinante en que las operaciones de ese casino o plataforma de casinos son ilegales independientemente de los términos y condiciones.

Las prácticas abusivas que puedo demostrar de estos casinos como, no pago de premios ganados en sorteos, uno para retener ganancias con verificaciones de cuentas absurdas o bien cerrar sin ningún tipo de justificación las cuentas.

La nula falta de atención a la autoexclusión, el fomento del juego, las contestaciones robotizadas, la publicidad engañosa, no contestar y cerrar la cuenta cuando preguntas si tienen licencia, la apropiación indebida de fondos ...

Personalmente les ofrecí llegar a un acuerdo amistoso antes de adoptar las medidas legales tanto administrativas como penales que voy a adoptar contra ellos.

Ojo también con un gestor VIP que se hace llamar Miller, reitero y tengo pruebas para demostrarlo que todo es un auténtico fraude.

Te equivocas, la responsabilidad es absoluta por parte del casino, jurídicamente la ley del juego 13/2011 establece la obligación de todos los casinos online que operen para españoles o en territorio español es tener licencia en España , de lo contrario se considera juego ilegal , una infracción muy grave según la mencionada ley. La responsabilidad es únicamente del casino por operar sin licencia española, los clientes actuamos de buena fé contractual. Hay jurisprudencia al respecto y lo deja totalmente claro.

Mi queja es sobre Myempire, pero he tenido problemas con todos los casinos en los que he jugado y su plataforma es Novaforge Ltd. Nos actúan de buena fé, no velan por la salud mental de los jugadores vulnerables, los términos y condiciones son totalmente contrarios a la ley y favorecen exclusivamente a los casinos , por ejemplo. Ves normal que no haya límites de depósitos y si de retirada sólo 500-1500 dependiendo del nivel VIP? No hay una proporcionalidad contractual.

No tienen políticas de autoexclusión, de limitación de gasto si detectan que un jugador es potencialmente un adicto, etc

En resumen, no cumplen la legislación vigente en España y UE.

En cuanto a la solución, les he ofrecido en multitud de ocasiones llegar a un acuerdo amistoso, interno, confidencial y te aseguro que totalmente beneficioso para Novaforge Ltd y no he obtenido respuesta alguna. Por eso decidir escribir en este foro y empezar la adopción de medidas administrativas y penales, pero te reitero que después de haber jugado en total de casinos Novaforge Ltd aproximadamente unos 60.000 euros ( de ellos más de 36000 en Myempire) y no haber retirado nada, y ofrecerles un acuerdo por 1500-2000 euros y no obtener respuesta, me he visto obligado como he dicho anteriormente , a adoptar las medidas administrativas y penales que serán mucho más beneficiosas para mí , así como denunciar a VISA los depósitos por incumplimiento de contrato y apropiación indebida. Eso demuestra mi buena voluntad y lo abierto que estaba a llegar a un acuerdo que sólo me daba un triunfo moral, porque en lo económico perdía casi el 100%, aún siendo juez en ejercicio y poder haber actuado con más contundencia.

Espero haberle aclarado mi punto de vista que coincide con la legalidad vigente .

Yo me estoy viendo involucrado también con ellos, en este caso con el casino Vikingluck.

Estuve 3 semanas para poder recibir el primer retiro, he recibido un retiro de 500€ después de 3 semanas.

Ahora estoy con el proceso de verificación y la verdad que me tienen loco, 29 días ya luchando con ellos.

Y tengo pendiente de recibir 9500€.

No se si me puedes dar algún consejo.
